I hired a fencer in Dec\'05 - after 3 1/2 months of delays I finally canceled and asked for my deposit back. First they said they had already bought the materials so no I could not have it back - I said fine deliver the materials and call it over. They came back and said they had been able to use the materials I purchase for another client and would give me my money back. Took us 3 1/2 months but they finally agreed only I cannot have my money back until May10th. There are hugh holes where they attempted a start a month and half ago which are dangerous. I have rocks and dirt sitting on plastic from the holes they dug which is sitting on newly laid sod ...I am sure it is dieing by now - They are charging me $300.00 for the holes they dug and the rest of my money is being held so I cannot hire someone else until then. The worst of this is that they introduce themselves to my neighbors while measuring my yard ...they also gave them a deposit which is being held until May as well.
I am wondering what would be recommended as a course of action to get our money back sooner so we can get these fences up?
