Do you need to be incorporated to hold rights to a trademark?

It is clear that the name Google was known when that check was written

I don\'t think being incorporated gives rights to a trademark.

Yes. The date their domain was registered is when its first usage took place. It preceded that of Google.com\'s first usage which is why they do have a case and it is going to court.

They have blocked the Trademark proceedings for Google.com at the Trademark Office level. They cannot legally block rulings from the Trademark Offices without just cause.

This will definitely be an interesting case to follow.

I\'d disagree with that, Deb. We don\'t know when the first usage took place for either party. Registration of a domain name cannot be contrued as first usage. A simple letterhead with the words on it could also be first usage. We don\'t know which came first.

Besides, I read somewhere that Stelor bought Googles only in 2002.

CBS News is covering it too.

Can you imagine how much traffic that Googles.com site is getting as a result of all of this?
